Marketplace terms
1. The marketplace’s role
“BartertoBarter” refers to the operator of this marketplace. The final terms will identify that operator. The marketplace helps members discover services, publish requests, compare offers, and communicate. Unless a separate written agreement expressly says otherwise, the operator does not supply, supervise, or perform the services offered by members and is not a party to their service or barter agreements.
A listing, message, or preferred-offer selection does not itself mean that BartertoBarter has booked an appointment, accepted a job, guaranteed a provider, or settled a trade. Members must confirm their agreement directly with one another.
2. Who may participate
Members must be at least 18 and legally able to enter an agreement. Anyone acting for a business must have authority to do so. Members must provide accurate account and listing information, protect their sign-in details, and report suspected unauthorized use. Accounts may not impersonate another person or business.
3. Independent member relationships
Members choose whether and with whom to trade. They set their scope, availability, values, and commercial terms. Use of the marketplace alone does not appoint a member as BartertoBarter’s employee, partner, representative, or agent. Members may not claim authority to bind the operator or promise that the operator guarantees their work. Any legal classification remains subject to applicable law and the actual relationship.
4. Licenses, insurance, and safe services
Providers are responsible for qualifications, permits, professional licenses, insurance, lawful working practices, and disclosures required for their services. Customers should check relevant qualifications and insurance independently before agreeing to work. A submitted document or profile badge describes only the status stated on the site; it is not a guarantee of competence, current coverage, safety, or regulatory approval.
Members must not offer unlawful services, misrepresent credentials, infringe another person’s rights, harass others, or use the marketplace for fraud. Services must comply with applicable licensing, employment, consumer protection, health, safety, and other laws.
5. Record the trade before work begins
Members should confirm a written agreement covering the following points. Required statutory contracts and notices still apply, including requirements for regulated services or home improvement work.
- The legal names and contact details of both parties, and the authorized provider.
- The work, deliverables, location, exclusions, and standard for completion.
- The date, arrival window, deadlines, and access or safety requirements.
- The services exchanged, their agreed values, and any cash payment or material costs.
- Who supplies parts, obtains permits, and pays applicable taxes or charges.
- Cancellation, rescheduling, change orders, refunds, warranties, and remedies for incomplete work.
- How both parties approve changes and resolve a disagreement.
Keep a copy of the agreement and completion records. A platform message or preferred offer does not replace a legally required contract. Neither member may impose undisclosed charges or change agreed terms without the other party’s consent.
6. Pilot membership, fees, and credits
The current development preview includes examples and a proposed membership model. It does not process payments, create confirmed bookings, or transfer trade credits. Example amounts are not funds held by BartertoBarter, and displayed credits are not presently redeemable balances.
Browsing is free. Current members can participate in the free membership pilot without payment details or a per-trade platform fee. Members remain responsible for charges they agree with each other, including materials and rush service. Members may exchange contact details and arrange trades outside the platform.
Paid membership for ongoing participation is proposed, with pricing still to be decided. Registering interest creates no subscription, payment obligation, or automatic conversion to a paid plan. Final features, prices, renewal, and cancellation terms must be disclosed before a member chooses to subscribe. Existing pilot members must expressly opt in to any paid subscription.
Any future platform fee, credit program, payment handling, refund policy, or settlement arrangement must be disclosed under separate finalized terms before it is used. These draft terms do not authorize the operator to collect a proposed fee or promise a future credit’s value.
7. Taxes and records
Bartering can create taxable income even when no cash changes hands. Members are responsible for their own records and tax obligations, including any required reporting of the fair market value of goods or services received. BartertoBarter remains responsible for any reporting or other duties the law places on the operator. Neither these terms nor a member-to-member agreement removes those duties.
8. Listings, messages, and availability
Members are responsible for the accuracy and legality of the content they submit and for having permission to share it. The operator may remove unlawful, misleading, abusive, or unsafe content and restrict accounts for violations or security reasons. Moderation or displaying a listing does not mean the operator endorses that member or assumes responsibility for their services.
Subject to applicable law, the marketplace is provided on an “as is” and “as available” basis. BartertoBarter does not warrant uninterrupted availability or that a member’s statements, work, or offers will meet another member’s expectations. Express commitments made by the operator and rights that cannot lawfully be excluded remain intact.
9. Limits concerning member transactions
To the extent permitted by applicable law, BartertoBarter is not responsible for a member’s breach of a trade agreement, failure to perform, inaccurate listing, defective service, undisclosed charge, or conduct toward another member. Claims about a member’s performance should be addressed to that member. This allocation does not excuse the operator’s own legally actionable conduct or remove duties the law assigns to the operator.
To the extent permitted by applicable law, the operator will not be liable for indirect, incidental, special, or consequential losses arising from use of the marketplace, such as lost profits or lost business opportunities. This proposed exclusion is subject to the exceptions below. No monetary cap on liability has been set in this draft.
Preserved rights: Nothing in these terms excludes or limits liability for fraud, willful misconduct, gross negligence, or any other liability that cannot lawfully be excluded or limited. Nothing waives nonwaivable consumer rights, legal remedies, or the operator’s own violation of law. If a limitation is prohibited in your circumstances, it does not apply to that extent.
10. Claims caused by a member’s conduct
To the extent permitted by law, a member is responsible for reasonable third-party claims and resulting losses caused by that member’s unlawful conduct, infringement, or material breach of these terms. This responsibility does not cover the operator’s own wrongdoing or any share of a loss for which the operator is legally responsible. Any defense or settlement arrangement must preserve the member’s lawful rights and may not impose an admission or nonmonetary obligation without consent.
11. Disputes and reporting
Members should first try to resolve service disputes directly, using their written trade agreement and keeping records. They may report suspected fraud, unsafe conduct, or marketplace rule violations to the operator. The final terms will supply a monitored reporting contact. The operator may review reports and moderate accounts, but does not promise to adjudicate every dispute, reimburse a loss, or enforce a member’s agreement.
Members retain access to courts, regulators, and other remedies available under applicable law. This draft does not impose mandatory arbitration or a class-action waiver.
12. Applicable law and changes
The proposed operator is based in California. The final agreement is intended to use California law to the extent permitted, while preserving protections that must apply under other relevant law. Court venue and the operator’s legal details will be finalized before adoption.
Material changes to adopted terms should be brought to members’ attention before taking effect. New terms do not retroactively rewrite completed trade agreements. Existing members must be given an appropriate opportunity to review and accept finalized terms; merely viewing this draft is not recorded as acceptance.
Before trading: Review the other member’s credentials, confirm the work and exchange in writing, and keep your records.
